“Coercive control” is another Orwellian feminist legal hoax that is exploited to prosecute decent, law abiding men who have committed no violence against their wives. Prior to the introduction of such totalitarian feminist legal hoaxes, a husband was not guilty unless he committed an objectively defined act (such as physical violence) against his wife.
“Orthodox” feminists may attempt to exploit “coercive control” laws to bypass the US First Amendment and force Jewish religious divorces.
It goes without saying that Jewish divorces performed by husbands subject to any coercion (especially family court coercion) are completely invalid under halacha (Jewish law).
I’m not an attorney, and I’m not offering legal advice here.
However the “Orthodox” feminists should not be celebrating the “coercive control” laws yet. I believe these “coercive control” laws may backfire very badly on the Jewish feminists, if any of these possible scenarios play out:
- Rabbis with any loyalty to Jewish law will publicly invalidate all Jewish divorces performed during any family court proceedings. Any fake “rabbis” who allow these divorces will be quickly exposed as the feminist politicians they are.
- “Coercive control” is Orwellian doublespeak. In fact it is the Jewish husbands who are being coerced to perform a religious ceremony not allowed by Jewish law. Jewish husbands might claim “coercive control” violations against their wives who are using any coercion to obtain a Get, such as utilizing agunah feminist organizations to persecute their husbands.
- Jewish husbands might simply write on a piece of paper “This is your Jewish Get – writ of divorce”. The court would then be forced to engage in a completely unconstitutional examination of the religious validity of that “Get”.
- No one is coercing Jewish wives to accept Jewish divorce law. A Jewish woman without a Get is free to remarry under civil law. The claim that a husband who simply refrains from performing a religious service is “coercing” his wife may be quickly tossed out of the courtroom by honest judges.
- Federal courts may rule emphatically against allowing family court involvement in Jewish religious divorces as it is a blatant First Amendment violation.
